Terms of Service

Please read these Terms of Service ("Terms") carefully before using Kitesurf Master (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and the creator of Kitesurf Master ("we", "us", or "our"). Your continued use of the App constitutes your acceptance of these Terms and any future modifications.

2. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on Meta Quest devices you own or control. This license does not include the right to:

Copy, modify, or distribute the App or its content
Reverse engineer, decompile, or disassemble the App
Rent, lease, lend, sell, or sublicense the App
Use the App for any commercial purpose

3. Meta Quest Platform

Kitesurf Master is distributed through the Meta Quest Store and requires a compatible Meta Quest headset. Your use of the Meta Quest platform and Store is subject to Meta's Terms of Service and applicable policies. We are not responsible for Meta's platform, services, or any issues arising from your use of Meta's products.

4. User Conduct

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to use the App in any way that could damage, disable, overburden, or impair the App, or interfere with any other user's enjoyment of the App.

5. Intellectual Property

The App and all of its original content, features, and functionality — including but not limited to graphics, audio, video, text, and software — are owned by us and are protected by applicable intellectual property laws. The Kitesurf Master name, logo, and all related names, logos, and distinctive marks are our trademarks.

6. Health and Safety

VR experiences may cause discomfort, disorientation, or motion sickness in some users. By using the App you acknowledge these risks and agree to:

Take regular breaks during use
Stop using the App if you experience discomfort
Use the App in a safe, clear physical space
Consult a physician before use if you have any medical conditions that could be affected by VR experiences

7. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the App — even if we have been advised of the possibility of such damages.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any significant changes by updating the "last updated" date at the top of this page. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions.
